- What are the practical implications of this case?
- What was the background?

Family analysis: In relation to a child placed for adoption by the local authority, the applicant father made an application under section 55A(1) of the Family Law Act 1986 (FLA 1986) for a declaration of parentage. The court considered whether it had jurisdiction to make such an order following the lawful adoption of a child, holding that it did have jurisdiction to grant a birth parent a declaration of parentage in some circumstances, but that it may refuse to hear the application if that was in accordance with the best interests of the child. Sarah Barber, barrister at No 18 Chambers, examines the issues.
