Public Law analysis: This public procurement challenge concerned the procurement of a ‘highways term service’ contract using the competitive dialogue process under the Public Contracts Regulations 2015 (PCR 2015), SI 2015/102. The claimant challenged the contract award decision on the basis that the contracting authority’s instructions resulted in its tender receiving a lower score.
