Law360: The Court of Appeal upheld an appeal against a May 2018 decision by Mr Justice Robin Knowles CBE in which he set aside a notice of discontinuance filed by award creditors who had previously sought the recognition and enforcement of a New York Convention arbitral award in England. Although agreeing with the judge on several issues, the Court of Appeal held that the judge had been wrong to conclude that Kazakhstan had a legitimate interest in the continuation of the enforcement proceedings so as to obtain a trial of fraud allegations.
