Dispute Resolution analysis: Lavender J, in the High Court, has considered what costs order should be made where a claimant had alleged negligence by a defendant in relation to one cause of action and negligence by that defendant and others in relation to another cause of action. Negligence had been admitted by the one defendant in relation to the first cause, with the consequence that the claimant discontinued proceedings against the other defendants in relation to the second cause.
