Dispute Resolution analysis: The Law Society has responded to the consultation paper issued by the Judicial Executive Board (JEB) proposing reforms to the existing guidance for McKenzie friends—non-lawyers who offer assistance and in some cases seek to appear as advocates on behalf of litigants in person (LiPs). One of the proposals in the consultation was for a prohibition on McKenzie friends recovering fees and the Law Society has supported this. The Law Society is also of the view that the current guidance for McKenzie friends should not be elevated to rules of court, since this may imply that McKenzie friends are quasi-regulated.
