Employment analysis: The effective date of termination is a statutory concept. It is not something that the parties can simply agree. Where an employer makes clear it is withdrawing the contract of employment — even if purporting to replace it with a new contract — that is the communication of a dismissal for statutory purposes and will determine the effective date of termination, according to the EAT.
