Public Law analysis: Under the European Union (Withdrawal) Act 2018 (EU(W)A 2018), before certain statutory instruments are formally laid in Parliament, they have to go through a preliminary sifting process to determine the appropriate parliamentary procedure. The latest draft Brexit SIs laid for sifting are reported here. Subjects covered include amendments to transport legislation in the field of Air Traffic Management (ATM) to ensure that relevant retained EU law applies appropriately within UK airspace and does not adversely affect the procurement of new equipment after the end of the Brexit transition period on 31 December 2020 (IP completion day). Amendments are also made to the Air Traffic Management (Amendment etc.) (EU Exit) Regulations 2019 to remove the requirement for manufacturers or their authorised representatives to be established in the UK for the purposes of making declarations of conformity or suitability for use in relation to their manufactured constituents.
