Public Law analysis: Under the European Union (Withdrawal) Act 2018 (EU(W)A 2018), before certain statutory instruments are formally laid in Parliament, they have to go through a preliminary sifting process to determine the appropriate parliamentary procedure. The latest draft Brexit SIs laid for sifting are covered here. Subjects covered include amendments to legislation in the fields of animal and aquatic health, invasive alien species, plant propagating material and seeds, to ensure that environmental law continues to operate effectively after the end of the Brexit transition period, reflecting continuing obligations under the Withdrawal Agreement, including the Northern Ireland Protocol, and directly applicable EU legislation made during the transition period. The amendments are described as being ‘technical in nature with no changes to policy’.
