Arbitration analysis: The use of tribunal secretaries in international commercial arbitration has become a hot topic. The key issue is the question of where is the line to be drawn between legitimate support provided to the tribunal, and improper delegation of duty by the arbitrator/s to a tribunal secretary. Following the release of Berwin Leighton Paisner LLP’s (BLP) International Arbitration Survey 2015, Carol Mulcahy, partner in the firm’s international arbitration group, considers this important issue.
