This week’s edition of Arbitration highlights includes our coverage of four English High Court decisions. In the first, a jurisdiction challenge brought pursuant to section 67 of the Arbitration Act 1996 (AA 1996), the court agreed with the arbitrator’s finding that she had jurisdiction in a partnership dispute; in the second, the court upheld an appeal, brought under AA 1996, s 69, from an award which made findings on the variation of terms of a partnership agreement; in the third, the Commercial Court dismissed AA 1996, s 67 and s 68 challenges to an arbitral award by which the tribunal found, amongst other matters, it had jurisdiction to determine disputes already determined by an independent expert in ‘final and binding’ proceedings, and in the fourth, in the context of a contested claim for the enforcement of an international arbitration award under AA 1996, s 103, the Commercial Court dismissed the defendant’s application for an order to declare inadmissible various paragraphs of an expert report of a leading arbitrator and a joint expert report.
