Information law analysis: The Court of Appeal has dismissed both an appeal by the claimants regarding the level of damages awarded and a cross-appeal by the defendants on liability in this judgment involving a claim for misuse of private information concerning footage of a couple being evicted from their home which was shown on Channel 5’s television programme ‘Can’t Pay? We’ll Take it Away.’ Among other things, the court held that the High Court had not erred in its assessment of the balancing exercise between the claimants’ privacy rights and the defendant’s right to freedom of expression.
