IP analysis: The Court of Justice has dismissed an appeal by Mast-Jägermeister SE in relation to a General Court finding that it had been correct for an EUIPO examiner to treat as defective an application for a Community design in respect of beakers where the representation of that design had included both bottles and beakers. In the circumstances, the EUIPO had been correct to treat the application as having not been filed and to therefore refuse to attribute a date of filing.
