IP analysis: The Court of Justice has annulled decision 8512/15 of 7 May 2015 of the Council of the EU authorising the opening of negotiations on a revised Lisbon Agreement on Appellations of Origin and Geographical Indications. The reason for the annulment of the decision was that the negotiation of the Lisbon Agreement fell within the exclusive competence which the Treaty on the Functioning of the EU confers on the EU in the field of common commercial policy. However, the Court of Justice held that the effects of the decision were to be maintained until the entry into force of a further decision of the Council of the EU.
