The Government has referred to the Supreme Court the question of whether the Agricultural Sector (Wales) Bill, which has been passed by the National Assembly for Wales but is yet to receive royal assent, is within the National Assembly's competence. In the meantime, the Government has decided to continue the agricultural minimum wages regime in Wales, pending the Supreme Court hearing in December 2013, in order to provide certainty for agricultural workers and employers in Wales. As a consequence, changes have been made to recent secondary legislation so that the separate employment regime for agricultural workers will cease with effect from 1 October 2013 in England only.
