Employment analysis: An enhanced hourly rate of pay cannot compensate for less holiday or rest break pay being given to agency workers who have worked in a job for at least 12 weeks. In addition, such agency workers have no entitlement to the same number of working hours as comparable direct recruits although their working time should not exceed that which would ordinarily apply to employees, eg they may not be made to work longer shifts than ordinarily apply to directly recruited employees, according to the EAT.
