Brexit impact

11 pm (GMT) on 31 December 2020 marks the end of the Brexit transition/implementation period entered into following the UK’s withdrawal from the EU. At this point in time (referred to in UK law as ‘IP completion day’), key transitional arrangements come to an end and significant changes begin to take effect across the UK’s legal regime. Any changes relevant to this content will be set out below. For further guidance, see Practice Note: Brexit—impact on environmental law and News Analysis: Brexit Bulletin—key updates, research tips and resources.

Waste (Miscellaneous Amendments) (EU Exit) (No. 2) Regulations 2019

The Waste (Miscellaneous Amendments) (EU Exit) (No 2) Regulations 2019, SI 2019/188, introduce amendments to multiple pieces of EU-derived domestic legislation to correct deficiencies in this legislation arising from the UK’s withdrawal from the EU. This includes amendments to the regulations that implement the WEEE Directive (recast) including some additions in terms of how cross-references to the underlying WEEE Directive (recast) should be read when applying these regulations.

Details on how to read the cross-references to the WEEE Directive (recast) alongside implementing regulations are covered in the specific content we have on the implementation of this regime, such as in:

  1. WEEE—what is waste, electrical, electronic equipment (WEEE)?

  2. WEEE—producer obligations

  3. WEEE—business users and local authority responsibilities
