The Investigation Committee

The Investigation Committee considers allegations referred to it by the Registrar of the General Medical Council (GMC).

Its procedures are governed by the General Medical Council (Fitness to Practise) Rules Order of Council 2004 (GMC Fitness to Practise Rules 2004), SI 2004/2608.

The GMC Registrar must refer allegations to the Investigation Committee if the GMC case examiners cannot agree as to the disposal of an allegation under the GMC Fitness to Practise Rules 2004, SI 2004/2608, Sch, r 8(2) or whether to recommend that the practitioner be invited to comply with undertakings under rule 8(3).

The Investigation Committee also convenes where a practitioner has requested an oral hearing to determine whether a warning should be given.

Composition of Investigation Committee

The composition of the Investigation Committee is governed by the General Medical Council (Constitution of Panels, Tribunals and Investigation Committee) Rules Order of Council 2015, SI 2015/1965.

The Investigation Committee consists of:

  1. a chair

  2. a medical panellist, and

  3. a lay panellist

Referral to Investigation Committee under rule 8

The Registrar of the GMC must refer an allegation for consideration by the Investigation Committee if the case examiners cannot agree as to the disposal of an allegation under the GMC Fitness to Practise Rules 2004, SI 2004/2608, Sch, r 8.

After considering the allegation the Investigation Committee may:

  1. determine that the allegation should not proceed further
