Many issues arising from IT contracts relate to late or wrong performance of contractual obligations, by the provider or the customer, which are situations that should be foreseen in the agreement. For instance, in case of default of payment or lack of activity reports by the customer using the technology, it is usually recommended that provision is made for cure periods in the contract to remedy such default. Because of the technical aspect of IT contracts, the allocation of responsibilities between the parties is key; in many IT contracts, customers are not very familiar with the technology supplied by the service provider, which is therefore subject to an obligation of advice.
