Costs management in the TCC

Does formal costs management apply?

The Technology and Construction Court (TCC) spans both the High Court and the County Court. The costs management provisions in the Civil Procedure Rules (CPR) and the Technology and Construction Court Guide apply in both the High Court and the County Court. The Technology and Construction Court Guide, para 16.3.9 sets out which, if any, costs management regime applies. For cases started after 1 April 2013, and unless otherwise directed by the court, the costs management rules set out in CPR 3.12–CPR 3.18 and CPR PD 3E generally apply.

General approach to costs management

The general approach of the TCC to costs management is set out in the Technology and Construction Court Guide, para 5.1.1. It provides that the court will generally give directions at the outset of the case for the conduct of the proceedings up to trial 'to serve the overriding objective of dealing with cases justly and at proportionate cost'. It goes on to say:

'Since the introduction of costs management the control of costs will be an important factor in how cases are
