  1. partly on the doctrine of waste, and

  2. partly on an implied obligation to use the premises in a 'tenant-like manner'

Waste

Waste is any act which changes the nature of the premises whether for better or worse. There are four types of waste:

  1. ameliorating waste—improves the land, or perhaps its value

  2. voluntary waste —any act which leads to the destruction of premises or changes their nature
