Local authority tenancies — termination of flexible tenancies
Croydon London Borough Council v Kalonga [2020] EWHC 1353 (QB)
The Court of Appeal is to hear the appeal on 15 or 16 December 2020.The High Court decided that a local authority will be unable to obtain possession within the fixed term unless there is an explicit re-entry or forfeiture clause in the tenancy agreement. If there is, it will be able to obtain the court orders mentioned in section 82(1A) of the Housing Act 1985 (HA 1985) (one of which is for possession). However, it appears that the law on forfeiture does not apply if these routes are available.
