Kensquare Ltd v Boakye [2020] UKUT 359 (LC), [2021] All ER (D) 21 (Jan)
The Court of Appeal is due to hear the appeal on 27 and 28 October 2021.The Upper Tribunal (Lands Tribunal) (UT) held, in agreement with the appellant and contrary to what the FTT had decided, that: (i) interim service charges were payable as demanded by the landlord; (ii) the previous proceedings had been taken for the purpose of serving a notice under section 146 of the Law of Property Act 1925 and that the costs of those proceedings could be recovered by the landlord under the relevant provision of the lease; and (iii) the legal costs incurred in the previous and present proceedings had been incurred in connection with the management of the building and were therefore recoverable as part of the service charge.
