Rakusen v Jepsen [2020] UKUT 298 (LC)
The Court of Appeal is due to hear the appeal on 21 or 22 July 2021.The Upper Tribunal (Lands Tribunal) (UT) held that the First-tier Tribunal (Lands Chamber) (FTT) had correctly decided that the freehold owner of a property (the superior landlord), rather than the immediate landlord of the tenants, had been the appropriate landlord for the making of a rent repayment order (RRO). The tenants made the applications for RROs on the grounds of 'control or management of an unlicensed HMO’. The UT held that, while the freehold owner had not been the tenants' direct landlord, the only restrictions set for liability for an RRO, as set out in section 40(1) of the Housing and Planning Act 2016 were that the freehold owner had been 'a landlord' and had committed an offence—as held in Goldsbrough v CA Property Management Ltd [2019] All ER (D) 195 (Oct), which the FTT had been bound by and with which the UT agreed.
