No.1 West India Quay (Residential) Ltd v East Tower Apartments Ltd [2020] UKUT 163 (LC)
The Court of Appeal is due to hear the appeal on 14 or 15 April 2021.The First-tier Tribunal (Property Chamber) (the FTT) had ruled on an action between the parties regarding charges for electricity and other utilities supplied by the appellant landlord company to apartments in a building held by the respondent leaseholder company on long leases (see News Analysis: Charge for utilities not dependent on reliable meter readings (East Tower v West India)). The appeal against the FTT's decision raised three issues and was dismissed on two, but allowed on the third which related to the collection of standing charges. The proceedings were remitted to the FTT for further consideration in relation to that issue, together with outstanding issues going to the quantification of the charges payable by the respondent (the FTT's second decision). In the present proceedings, the UT ruled on the appeal by the parties against certain aspects of the FTT's second decision, including the issue as to whether
