Packaging waste—producer responsibility obligations

The Producer Responsibility Obligations (Packaging Waste) Regulations 2007, SI 2007/871 (PRO(PW)R 2007) implement those provisions on the European Directive on Packaging and Packaging Waste 94/62/EC (PPWD) that deal with recycling and (pre-2021) recovery targets for packaging waste and which are based on the principles of producer responsibility.

Producer responsibility is the principle that those businesses responsible for producing waste should also be responsible for recycling that waste, to reduce the levels of waste going to landfill.

PRO(PW)R 2007 are amended, as and when changes are made through amending regulations—some of which apply only in England, Wales or Scotland and some of which apply across Great Britain.

Brexit impact

11 pm (GMT) on 31 December 2020 marks the end of the Brexit transition/implementation period entered into following the UK’s withdrawal from the EU. At this point in time (referred to in UK law as ‘IP completion day’), key transitional arrangements come to an end and significant changes begin to take effect across the UK’s legal regime. Any changes relevant to this content will be set out below.
