The 19 November 2015 Sponsor Guidance for Tiers 2 and 5 (SG) makes a number of significant changes to the compliance regime for sponsor employers under Tiers 2 and 5 the Points-Based System, in addition to reflecting Immigration Rules changes which came into force on the same date (see Practice Note: Statement of Changes in Immigration Rules, HC 535—summary).
In the introduction to the new SG, from p xii–xv, the Home Office has provided a summary list of changes to the guidance. While this list does cover most of the changes, it does not set out all of them, nor is it always fully clear from the Home Office's summary as to how the changes are effected. In this analysis, the Lexis®PSL Immigration team has compared the November 2015 SG against the preceding (6 April 2015, last amended 17 September 2015) version in detail and set out the key changes in wording between both documents as they will effect business practitioners. Note that this summary focuses on changes relating to sponsor compliance, although a number of the most important changes which relate to the Tier 2 (General) and Tier 2 (Intra-Company Transfer) categories are also covered.
