On 22 April 2014, the fees for non-contentious probate applications were amended by the Non-Contentious Probate Fees (Amendment) Order 2014, SI 2014/876 (NCPF(A)O 2014), further to a review of fees across the civil court system. The NCPF(A)O 2014 amends the Non-Contentious Probate Order 2004, SI 2004/3120, as amended.

According to the Explanatory Memorandum to the NCPF(A)O 2014, the dramatic increase in the fee for an application for a grant of probate from £45 to £155 was aimed at ensuring that the fee recovered the full cost of the service being provided. The other changes were intended to ensure that the fees for similar processes across all courts were aligned to provide greater clarity for court users and staff.
