The first defendant was a Spanish company which provided fertility treatment to the first and second claimants. The second defendant were the first defendant’s liability insurers.

In late 2010 or early 2011, the claimants entered into a contract for the provision of fertility treatment with the first defendant. Unfortunately, there was a mutation that caused the third and fourth claimants to be born with cystic fibrosis.

The claimants brought claims (i) in tort for breach of the duty of care and (ii) in contract, and brought a direct claim against the insurer on the basis that the level of insurance cover available may not have been sufficient to cover the value of their claims.
