Health and safety policy—regulatory requirements

This Practice Note covers compliance and regulatory requirements relating to health and safety (H&S) and, in particular, the requirements for a written Health and safety/H&S policy.

What is a Health and safety policy?

A Health and safety policy is a document that sets out the organisation’s principles and objectives for ensuring the health and safety of staff and visitors.

Regulatory requirements

Lexcel

The Lexcel England and Wales v6.1: Standard for legal practices includes a specific requirement for organisations to have a ‘policy in relation to the health and safety of all personnel and visitors to the practice’. There is a similar requirement for in-house legal teams who wish to achieve Lexcel accreditation.

The Lexcel Standard defines a policy as a documented general approach taken within the practice to the issue in question and a document that defines why a particular approach is adopted by the practice. The policy must:

  1. have a named person who is responsible for the procedure, and

  2. be reviewed at least annually

Lexcel requirements should be considered compulsory for organisations that have or are working towards Lexcel accreditation; they are not compulsory for other organisations although they provide an indicator of good
