DIAC—costs

CORONAVIRUS (COVID-19): Many arbitral organisations have responded to the coronavirus pandemic with practical guidance and/or changes to their usual procedures and ways of working. For information on how this content and relevant arbitration proceedings may be impacted, see Practice Note: Arbitral organisations and coronavirus (COVID-19)—practical impact. For additional information, see: Coronavirus (COVID-19) and arbitration—overview].

As in any arbitration, it is important that the parties understand the costs that are likely to be involved in the case and when they are likely to need to pay those costs. There are two elements to costs:

  1. costs of the arbitration

  2. each parties’ own legal costs

References to articles in this Practice Note are to articles in the arbitration rules of the Dubai International Arbitration Centre (DIAC and the DIAC Rules).

Costs of the arbitration

The costs of the arbitration include (Appendix—Art 2):

  1. DIAC’s administrative fees for the claim and any counterclaim

  2. fees and expenses of the tribunal

  3. fees and expenses of any expert appointed by the tribunal

In addition, each party will of course bear the costs of its own legal team and any expert witness during the course of the arbitration.

When are the costs of the arbitration to be paid?

Registration fee

On filing the Request for Arbitration or any counterclaim, the registration fee of Rhs 5,000 must be paid to DIAC. DIAC’s Rules do not state how this is to be paid,
