The Lugano Convention 1988 was brought into UK law by Schedule 3C of the CJJA 1982 and subsequent orders. As a consequence, amendments to these statutory instruments were required to reflect the provisions of the Lugano Convention 2007. These are set out in the 2009 Regulations, SI 2009/3131. The regulations amend the following:

  1. the CJJA 1982:

    1. the definition of the Lugano Convention in section 1 is amended to refer to the Lugano Convention 2007 (SI 2009/3131, reg 3)

    2. the enforcement of judgments, other than maintenance orders in section 4 is amended with the addition of a new para 4A (SI 2009/3131, reg 5)

    3. the recognition and enforcement of maintenance orders in section 5 is amended with the addition of a new para 5A (SI 2009/3131, reg 6)

    4. the provisions for appeals under Article 44 and Annex IV in section 6 are amended with the addition of a new para 6A (SI 2009/3131, reg 7)
