What is the applicable regulatory framework for the authorisation, pricing and marketing of pharmaceutical products, including generic drugs? Law No. 1262 on Pharmacies and Pharmaceuticals (published in the Official Gazette numbered 898 and dated 26 May 1928) is the main legislation regulating the marketing, authorisation and pricing of pharmaceutical products. Licencing of pharmaceuticals is executed according to the Licensing Regulation on Medicinal Products for Human Use (Licensing Regulation), which was published in the Official Gazette No. 25705 on 19 January 2005 and is made in close connection with the Directive 2001/83/EC of 6 November 2001 on the Community Code relating to Pharmaceutical Products for Human Use. According to the Licensing Regulation, in Turkey, medicinal products for human use are to be licenced. While the licences are granted by the Ministry of Health, licences for licensing and marketing of pharmaceuticals are separately required. The Regulation on Variation in the Licence Application Pending Product, published in the Official Gazette of No. 25823 on 23 May 2005 is also modelled similarly to the Commission Regulation (EC) No. 1084/2003 of 3 June 2003, and it specifies the rules and application principles

The most relevant SRA Principle is the requirement to run your business or carry out your role in the business effectively and in accordance with proper governance and sound financial and risk management principles. Requirements relating to negligence and PII can be found in the SRA: • Code of Conduct 2011, and • Indemnity Insurance Rules 2013 SRA Code of Conduct 2011 The SRA Code of Conduct 2011 describes outcomes that you must achieve in order to comply with the SRA Principles. These outcomes are mandatory and are supported by indicative behaviours. Distributed Antenna Systems—Mr Justice Mellor ‘signals’ his SOLiD disapproval with CommScope’s case but declines to ‘interfere’ with application to amend (CommScope v SOLiD)

IP analysis: The Patents Court has ruled on the validity and infringement of one of CommScope’s patents relating to distributed antenna systems (DAS), holding that, had the patent been valid, it would have been infringed. The Patents Court also held that it did not have jurisdiction to amend another of CommScope’s DAS patents because the claim in respect of that patent had been discontinued.
