GLOSSARY

Agnate definition

What does Agnate mean?

The relationship between persons through the father.

Agnates are distinguished from cognates, who are persons related through the mother. The terms were relevant to a child's common law right to aliment where the father is dead or unable to provide support. The child could claim firstly against the mother, then agnates and then cognates. Child support is now governed by statute. See Family Law (Scotland) Act 1985 and Child Support Act 1991.
