D.     Public employees

Broadly speaking, where a worker works for a government agency or quango, then a disclosure made to a government minister or member of the Scottish Executive is a protected disclosure (ERA 1996 s 43E). To be precise, the Act protects such disclosure where the worker's employer is an individual or a body appointed by a Minister of the Crown or a member of the Scottish Executive under statutory powers.
