C.     Meaning of 'applicant'

An 'applicant' is defined in the ERA 1996 s 49B(2) as:

''an individual who applies to an NHS employer for -

(a)     a contract of employment,

(b)     a contract to do work personally, or

(c)     appointment to an office or post.''

It can be seen immediately from this that (as with the ordinary whistleblowing provisions) this covers not just a potential 'employee' but also a potential 'worker' (see para [10] above).
