C.     Remedies

An employee who is not permitted time off in accordance with ERA 1996 s 50 may present a complaint to an employment tribunal (ERA 1996 s 51). A complaint must be presented within three months of the date on which the failure complained of occurred, or within such further period as the tribunal considers reasonable where it is satisfied that it was not reasonably practicable for the complaint to be presented before the end of the period of three months (s 51(2)(a) and (b)).
