(4)     Compensation for time off refused

If the employer refuses to allow time off (as to which see para [57], point (6), above) and does so unreasonably, then the employee is nevertheless entitled to be paid a sum of money equivalent to the amount to which he or she would have been entitled under the Act, had he or she in fact been allowed to take time off (ERA 1996 s 53(4)), and subject always to the maximum limit of two fifths of a week's pay per period of notice, which applies whether the claim
