(2)     The right

The right conferred by ERA 1996 s 63A has two parts. Firstly, there is a right to be permitted by the employer to take time off during the employee's working hours in order to undertake study or training leading to a relevant qualification (s 63A(1)). 'A relevant qualification' is an external qualification the attainment of which would contribute to the attainment of the standard prescribed in the Training Regulations and would be likely to enhance the employee's employment prospects (whether with his or her current employer or otherwise): s 63A(2)(c).
