(2)     The amount of time off

The amount of time off which the employee may claim under the statute is whatever is reasonable in the circumstances (ERA 1996 s 52(1)). The Act offers no criteria of reasonableness, but it does indicate that the employer is not obliged to pay for more than (for a five day a week employee) two days' absence: the limit on monetary compensation which may be awarded by a tribunal under these provisions is two fifths of a week's pay (ERA 1996 s 53(5)).
