(1)     Who has the right?

The rights to time off conferred by ERA 1996 ss 63A63C are available to employees in Wales and Scotland who are aged 16 or 17, who are not receiving full-time secondary or further education, and who have not attained the applicable standard of achievement which has been prescribed by regulations made by the Secretary of State (ERA 1996 s 63A(1)). The rights are also available to 18-year-olds who would qualify if aged 16 or 17, are undertaking study or training leading to a relevant qualification and who began such study or training before they attained the age of 18.
