Section 40 of the Apprenticeships, Skills, Children and Learning Act 2009 inserts ERA 1996 Part 6A, comprising ss 63D–63K, which confer new rights for 'qualifying employees' to make an application to their employer for the purpose of enabling the employee to undertake study or training within the ambit of s 63D.
