(5)     Pattern of work

WTR SI 1998/1833 reg 8 provides, somewhat enigmatically, that where the pattern of work is such as to put the health and safety of a worker employed at risk, in particular because the work is monotonous or the work-rate is pre-determined, the employer shall ensure that the worker is given adequate rest breaks. This probably represents one of the high water marks of vagueness in the WTR; this may reflect the fact that the regulation is an attempt to paraphrase art 13 of the WTD.
