(4)     'Collective agreement'

'Collective agreement' means an agreement within the definition in TULR(C)A 1992 s 178; see further NI [3203] ff. It should be noted that it is not enough that there is a provision of a collective agreement; it must have been incorporated into the particular worker's contract, and this would need to be established, applying the usual contractual principles, in the event of dispute; these are more fully discussed at NI [3255] ff. The definition in s 178 is relatively broad.
