(3)     Protected shop workers and protected betting workers

Special privileges are accorded to protected shop workers (as defined) and to protected betting workers (as defined). A protected shop or betting worker is either

  1.  

    (a)     an employee in England or Wales who was employed as a shop or betting worker on the day preceding the relevant commencement date (26 August 1994 for shop workers, 3 January 1995 for betting workers) but not to work only on Sunday, and who has been continuously so employed since then (ERA 1996 s 36(2)); or

  2.  

    (b)     a shop or betting worker, whenever first
