(2)     Opting out of Sunday work

A shop or betting worker who is or may be required to work on a Sunday, but is not employed to work only on Sundays, has the right to opt out of any requirement for Sunday working by serving a written and signed notice of objection (ERA 1996 s 40). Such a notice becomes effective after a period of three months from the date on which the notice is given (s 41(3)).
