The 48-hour week maximum imposed by reg 4 may be disapplied by agreement in writing (often referred to as an 'opt-out') between the employer and the worker (WTR SI 1998/1833 reg 4(1), as amended by the Working Time Regulations 1999, SI 1999/584). For this purpose, the agreement must either relate to a specified period or apply indefinitely and, in the absence of a provision to the contrary, is terminable by the worker giving not less than seven days' notice in writing to the employer (WTR SI 1998/1833 reg 5(2)(a) and (b)).
