B.     Who has the right?

(1)     Shop workers

A shop worker is anyone who, under his or her contract of employment, is required to do shop work. In this regard 'shop work' is defined to mean work in or about a shop (not necessarily work involving serving customers) on a day when the shop is open for the serving of customers (ERA 1996 s 232(2)). 'Shop' is defined by s 232(3) as including 'any premises where any retail trade or business is carried on'. Other provisions of s 232 broaden the definition somewhat to include as
