I.     Protection Against Dismissal and Detriment

Workers are given specific statutory protection against dismissal, selection for redundancy and being subjected to a detriment where such treatment occurs because:

  1.  

    (i)     the worker has exercised or intends to exercise their rights under the NMWA 1998;

  2.  

    (ii)     the employer has been prosecuted for an offence under NMWA 1998 s 31 as a result of action taken by or on behalf of the worker; or

  3.  

    (iii)     the worker was about to qualify for entitlement to the national minimum wage or a particular rate of the national minimum
