(e)     Linked periods of incapacity for work

Two periods of incapacity are treated as one – or 'linked' – if they are separated by not more than eight weeks (SSCBA 1992 s 152(3)). This means that, other things being equal, the employee may be able to claim SSP from the first day of absence in the second period without having to endure three 'waiting days', provided the waiting days have been served in the first period.
