A further factor to bear in mind when considering bonus schemes is the impact of discrimination law on their operation. So for example in Land Registry v Houghton UKEAT/0149/14 (12 February 2015, unreported) the EAT held that a bonus scheme which automatically excluded employees who had been issued with formal warnings for sickness absence (even where the absence had been disability related) was discriminatory.
