(d)     Qualifying days

(i)     Identifying qualifying days

Having established the first two qualifying conditions for payment of SSP, namely that (i) a day of sickness forms part of a period of incapacity for work and (ii) it also falls within a period of entitlement, the employee must then satisfy the third condition and show that the particular day of sickness absence is a 'qualifying day' (albeit the employee cannot normally claim until the fourth qualifying day because of the 'waiting days' rules: see para [131]). So the next question to settle is whether the day for which SSP is claimed is a 'qualifying day' (SSCBA 1992 s 154 and SSP(G)R, SI 1982/894 reg 5).
