(b)     Uplift for failure to follow the ACAS Code

The provisions of the Trade Union and Labour Relations (Consolidation) Act 1992 s 207A, which govern the adjustment of tribunal awards where there has been a failure to follow the ACAS Code of Practice on Disciplinary and Grievance Procedures (2009) (see S [1]), apply to claims for unauthorised deductions and payments brought under ERA 1996 s 23. Under s 207A, a tribunal has a discretion to reduce an award by up to 25 per cent 'if it considers it just and equitable to do so'
