If an employment tribunal finds a complaint well founded, it must make a declaration to that effect and, subject to the provisions of ERA 1996 s 25 discussed at para [379.01] below, must order repayment of the deduction(s) made or payment(s) received in full: see ERA 1996 s 24(1). Employment tribunals are entitled to make any award gross, leaving it to the employer to work out exactly how much of the gross sum should be paid to the worker and how much to HMRC:
